Joseph S. Pecora, Jr.
Joe focuses his practice on business
counseling, commercial transactions, commercial litigation,
and criminal defense. Joe's litigation practice includes
extensive appellate work and civil and criminal trial
experience in the New Jersey State and Federal courts.
Joe has successfully handled a variety of complex business
ownership and governance disputes, employment disputes,
and contractual and tort claims. In addition, Joe's criminal
litigation experience includes internal investigations,
complex motion practice, subpoena response, trials and
post-conviction relief involving constitutional interpretation
and statutory construction issues of first impression,
and collateral civil/criminal matters. Joe has also devoted
substantial time litigating constitutional issues ranging
from preemption to novel criminal procedure interpretations.
He is also often called upon to provide counsel in matters
of first impression under newly enacted statutes and
ordinances.
Joe also provides advice and services to corporate clients on business entity
governance matters, operating structures, shareholder and operating agreements,
employment issues, including the retention and termination of employees, employment
practices and policies, and restrictive covenant matters. His experience includes
transactions involving strategic alliances, stock and asset transfers, financing,
distribution, sales, and licensing agreements. Joe's services also include advice
in the areas of trade secrets, intellectual property protection, real estate,
privacy law, regulatory law, and general business risk management.
Joe's clients include those involved in information technology, e-learning, application
service providers, retailers, distributors and manufacturers of technology and
machinery and medical practices.
Prior to joining OlenderFeldman, Joe previously practiced at McGlynn, Reed, Hense & Pecora
and the Law Office of Joseph S. Pecora. He received his Juris Doctorate degree
from the John Marshall Law School in Chicago, Illinois where he received a partial
academic scholarship, and served on the Moot Court Board. Joe received a Bachelor
of Arts in business and political science from Skidmore College in Saratoga Springs,
New York. He was qualified as certified mediator under New Jersey Court Rule
1:40 for municipal court mediations, and volunteered his time conducting numerous
mediations. He has also devoted pro bono time reviewing, critiquing and
grading law student briefs for moot court competitions.
